Mid-term renewal of Council of the Nation: Constitutional Court reminds of the conditions and modalities for submitting appeals

The Constitutional Court recalled, Thursday in a press release, the conditions and modalities for the presentation of appeals on the occasion of the renewal election of half of the elected members of the Council of the Nation, as well as the election of the members of the Council of the nation (CN) for the new wilayas scheduled for next Saturday.

“In accordance with the provisions of Article 191 of the Constitution, (the Court) reminds the candidates for the renewal of half of the members elected to the Council of the Nation, as well as for the election of the members of the Council of the Nation for the new wilayas scheduled for Saturday February 5, 2022, that in accordance with the provisions of article 240 of the ordinance on the organic law relating to the electoral system: ‘Any candidate has the right to contest the results of the ballot by lodging an appeal, filed with the registry of the Constitutional Court’, according to the conditions of substance and form provided for by the aforesaid article 240 and articles 4 and 5 of the deliberations on the operating rules of the Constitutional Court relating to the renewal of half of the elected members as well as the election of members of the Council of the Nation for the new wilayas”, specifies the same source.

Concerning the formal conditions, the Constitutional Court underlines that “the applicant must be a candidate for the next deadline in the wilaya concerned”.

 “The appeal must be filed by the applicant candidate directly with the registry of the Constitutional Court within twenty-four (24) hours following the proclamation of the provisional results by the Independent National Authority for Elections (ANIE)”, explained the Court adding that “in the event that the applicant delegates a representative to lodge the appeal in his name, it is imperative, under penalty of rejection of the formal appeal, that the depositary be provided with a power of attorney authorizing him for this purpose “.

The Constitutional Court recalls that the request must be completed in Arabic and include the surname, first name(s), profession, address and signature of the applicant, mention of the Communal People’s Assembly or the People’s Assembly of the wilaya to which belongs the applicant.

With regard to the substantive conditions, the Constitutional Court indicates that the applicant “is required to set out in his application the object as well as the means and the reasons in support of his appeal, attach the supporting documents, while pointing out that the Constitutional Court decides on the appeals within three (3) clear days in accordance with article 241 of the organic law relating to the electoral system”.
